These terms and conditions apply to the use of the Amore Tours website found at www.AmoreTours.au 

These terms and conditions specifically refer to the following products and services which may be purchased or accessed via our websites:

• Bookings – an instant booking on the  Amore Tours website regardless of payment type
• Gift Cards

Throughout these terms and conditions, the above products and services are collectively referred to as 'Amore Tours Products'.

Making a Purchase

When you purchase and/or use an Amore Tours product, by clicking “BOOK NOW”, you become legally bound by these terms and conditions. Please do not proceed to purchase/use your Amore Tours product until you have read, understood, and accepted these terms and conditions.

When you make a purchase on behalf of another individual (such as purchasing an  Amore Tour or gift card for them) and you provide us with their personal information, you warrant that you are authorised to provide us with that personal information and that we are able to use that personal information for the purposes as set out in our privacy policy. This would include, for example, using their email address to undertake delivery of the purchase.

1. General

1.1 Unless otherwise defined in these terms and conditions, all terms used shall have the following definitions; AMORE TOURS: Provides boat tours under these general terms and conditions. Customer: Each natural person who enters into an agreement with AMORE TOURS, or who receives an offer which is governed by these general terms and conditions.

1.2 These general terms and conditions are applicable to all AMORE TOURS customer agreements. 

1.3 The Customer's agreement, without any remarks, is presumed to be in acceptance of these general terms and conditions. 

1.4 Each individual deviation from these Terms and Conditions must be explicitly agreed in writing. Any deviation from these terms and conditions shall apply only to that specific case and to that specific deviation.

1.5 If a situation occurs that is not described in these terms and conditions, this shall be judged in the spirit of these general terms and conditions.

1.6 AMORE TOURS may amend these terms and conditions from time to time.

2. General responsibilities

2.1 AMORE TOURS provides boat tours. The Customer shall behave in accordance with these general rules and will at all times bear responsibility for all passengers to comply with all general responsibilities. Should the Customer (or a person in the Customer's tour) not comply with the general responsibilities, then AMORE TOURS is entitled to terminate the agreement with Customer with immediate effect. In such event, there will be no right of restitution for any amount paid.

2.2 General opening hours of AMORE TOURS are: Monday to Sunday from 8am - 8pm. During these opening hours, Customer can book a tour. AMORE TOURS reserves the right to change these hours as necessary for daylight hours and seasonality.

3. The tour period: beginning, extension, end

3.1 The tour period begins at the arranged time. A Customer who is not present at said time to start the tour is not entitled to compensation by adjustment of the tour period to a later time.

3.2 Should Customer wish to extend the tour period during the tour period, they should first contact the AMORE TOURS by telephone. Should an extension be possible (at sole discretion of AMORE TOURS) the regular rate (see website) applies. AMORE TOURS will then extend the tour period as requested.

3.3 If Customer does not use the full reserved tour time and wish to return earlier, the Customer is not entitled to a refund for unused time.

4. Obligations of Customer and AMORE TOURS

4.1 At the beginning of the tour period, AMORE TOURS shall ensure to provide the Customer with a safety briefing in case of emergency. AMORE TOURS will ensure that the vessel is in appropriate condition and that required safety features are available. 

AMORE TOURS will ensure all vessels are fit for purpose.

4.2 AMORE TOURS will ensure the vessel is properly insured (third-party insurance) for the area in which the ship will be used according to the agreement.

5. Payment 

5.1 When making a reservation, the Customer shall pay the agreed tour rate to AMORE TOURS.

6. Damage and Liability

6.1 AMORE TOURS cannot be held liable for any personal injury or (subsequent) damage, regardless of the cause of said injury or damage, prior to, during, or resulting from the agreement between AMORE TOURS and Customer, unless established that this injury or damage was caused by AMORE TOURS through gross negligence. AMORE TOURS liability is always limited to at most the amount of the tour agreement.

AMORE TOURS is not liable for the loss and/or damage to any items brought onto the vessel by Customer.

7. Rescheduling and Cancellation

7.1 A tour reservation may be rescheduled up until 48hours before the start of the reservation without reason and at no cost.

7.2 Rescheduling within 48 hours of the start of the reservation is not permitted and non-attendance at the agreed time shall result in full tour payment. Any rescheduling offered within 48 hours is at the sole discretion of AMORE TOURS.

7.3 Cancellation of bookings is not permitted. If special circumstances of a non-attended booking require consideration, please contact AMORE TOURS, and at our discretion, we may provide credit for a new reservation. No circumstances shall warrant restitution of paid amounts.

7.4 In the event AMORE TOURS must cancel your booking due to unsafe weather conditions, the standard cancellation policy shall come into effect and the Customer will be offered a voucher for the full value of the booking to be used for bookings in the future.

8. E-Gift Card

 8.1 You can redeem your E-Gift card over the phone or by entering your unique E-Gift card number when booking online.

8.2 E-Gift cards are non-refundable and cannot be redeemed for cash.

8.3 All E-Gift cards are valid for 3 Years from the date of purchase. If you don’t use it, you lose it.

9. Lost E-Gift Cards

9.1 If an Amore Tours E-Gift card is received and subsequently lost, the recipient may be eligible to have a replacement e-gift card emailed to them.

Conditions for replacement of lost Amore Tours E-Gift card: 

1. The Amore Tours E-Gift card is still valid and has not yet been used.
2. Proof of purchase is provided, either an order number, purchaser's full name or purchaser's email address.
3. Amore Tours is able to correctly verify you as the original recipient.

10. Promotional Offers

Amore Tours offers promotional discounts and special offers from time to time ('Promotional Offers' or 'Promotional Codes'). If you have a Promotional Code, it should be entered at the final payment screen where prompted. By redeeming any of Amore Tours Promotional Codes or Promotional Offers, you agree to accept and comply with all of the following terms and conditions of use. 
1. Promotional codes carry a minimum spend value unless stated otherwise. This minimum spend value refers to payments made using any accepted payment method excluding vouchers and gift cards.
2. Promotional Offers and Promotional Codes cannot be used in conjunction with Gift Vouchers or Gift Cards.
3. If you have been provided a valid Promotional Code, you must enter it into the designated field in the shopping cart. Otherwise, your discount will not be applied.
4. Promotional Codes must be used before the designated expiration date. No extensions will be allowed under any circumstances.
5. Promotional Codes and Promotional Offers cannot be combined.
6. Unless otherwise specified Promotional Codes may only be used once per person.
7. Where multiple Promotional Codes are offered, only one can be used per transaction.
8. Where multiple discounts apply, the user will receive the maximum discount available.
9. Amore Tours reserves the right to verify the validity of Promotional Code use at any time. If there has been (or we have reason to believe there has been) any unauthorised use we will immediately act to rectify this.
10. Amore Tours reserves the right to remove any Promotional Offer or Promotional Code without notice at any time.
11. Promotional Offers and Promotional Codes may be subject to additional terms and conditions as specified in the relevant Promotion from time to time, including but not limited subscription to the Amore Tours newsletter.

11. Jurisdiction and disputes

11.1 Any disputes or complaints should be reported to AMORE TOURS in writing.

11.2 All legal relationships between AMORE TOURS and the Customer to which these terms and conditions apply shall be governed by the laws of Australia. In the absence of mandatory rules of law to the contrary, the Court of Queensland  has exclusive competent.
